Forum: "Justice" from the Moment Absolute Justice was Born

I am planning to present my view on the Tokyo Trials as one of Pierrot. I will use my position, not Japanese, not Korean, but I am the only one who is 'myself' (daredemo nai watashito site rekishiwo himotoku...) by discussing about the Tokyo trials. I think this augment is not only for reconsidering historical problem but we also can study how to make the world better with real justice. If you have any opinions and interests, please leave your message.

I raised a few points about the issues of two Trials especially Tokyo Trials before. As the beginning of our discussion, I want you to think about these questions and propose your own definition.

How were people deceived into the belief that winners always tell the truth?

Analysis of Tokyo Trials (International Military Tribunal for the Far East) & Nuremberg Trials, known as the most unusual cases in history.

• What happened the end of the World War 2?
• How were the trials begun and made the readiness?
• Why have these two trials investigated the fact again and again for over 50 years?

The back-ground of two trials as the category of similarities.

• Used the most complicated international judge system.
Focus on the INTERNATIONAL JURY SYSTEM.
• Juries were from various countries, however they were from country which had damaged by Japan or German and decided quickly, therefore, the trials was started without enough preparation and FLAGANT JUSTICE was fair if winners demonstrated.
• Both Japan and Germany lost the war and freedom of speech.
• This is the deliberate instant and FIXED TRIALS by United Nation, therefore, the world.

What is Tokyo Trials? What is the difference between two trials?

• There were no Japanese and German Juries for Tokyo Trials during every trial, otherwise, German Juries were admitted in a few cases of Nuremberg Trials although most juries were chosen by Soviet, France and England governments. Those three counties influenced and controlled new German government after the World War 2. Nuremberg Trials were to punish Nazi mainly and not every German community was punished.
• However, in Tokyo Trials, even people who didn’t take enough education for international convention, were from China and Philippine, and obviously had hated Japanese personally were chosen as juries.
• Most Japanese demand was ignored by both American command and united nation because they completed the list of crimes without reconsideration. In addition, it happened almost immediately the World War 2 was ended. It means that the juries had no responsibilities to judge equally and the judgment was already decided before the first trial.
• The worst fixed show trial in history is Tokyo Trials. There are many doubts how the trials were organized and who got a benefit by the trials. As I mention in paragraph 5, my first question about Tokyo Trials is how Juries were chosen. Second, how long the trials took a time to judge. And finally which country had the permission of this trial.
• In a few judgments in Tokyo Trials, a guilty decision was brought in by the judge within 10 min.
• When Pal, one of judges from India, protested the unfairness during the trials, his statements were completely ignored at the time. And his book about Tokyo Trials wasn’t published until American Government allowed. This is just one of examples. There was no freedom of speech for against the trials.
• Japanese Crimes had no permission to be against the judge without lawyers, however, lawyers for Japanese defendants were chosen by American officers or united nation.
• The Tokyo trials were composed by American government under Douglas MacArthur, who was the general of American army during the World War 2 and the Korean War (after the Korean War he was disgraced in the transaction of the war). Controlling the trials relating the war by one country is unusual case.
• Why the emperor Hirohito was not judged is MacArthur’s decision to control Japan under American government. MacArthur strongly believed that using the emperor system is necessary to keep the sovereignty over Japan.
• Law was entirely legislated by MacArthur and American government. Before the World War 2, Japanese legislation was built by Japanese lawmakers and European advisors and the foundation of the modern Japanese law was on the model of Code Napoleon and modern German laws. This augment should be focus on this paragraph because it is the most important point to discuss how American had tried to control Japan. Own country’s legislation shouldn’t be decided by other country’s ego.
